1. Agreement to Terms

By accessing or using TestHuman ("Service"), operated by Cluda AS, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

TestHuman provides app testing services performed by real humans. Our testers will follow your provided test steps on your specified URL and deliver results including screen recordings with voiceover, pass/fail verdicts and screenshots.

3. Pricing and Payment

• All prices are displayed and charged in USD (US Dollars).
• Pricing starts at $3 per test and varies based on complexity.
• After submitting a test request, we will review and provide a price quote.
• For your first test run, payment is required before testing begins.
• For subsequent test runs, your saved payment method will be charged when we deliver the results.
• Payments are processed securely through Stripe.

4. Service Delivery

• We will notify you when test results are ready.
• Delivery times may vary based on test complexity and current demand.
• Results will be delivered to the email address provided during submission.

5. User Responsibilities

By using our Service, you agree to:

• Provide accurate and complete information when submitting tests
• Ensure you have authorization to test the URLs you submit
• Not submit malicious, illegal, or harmful content
• Not use our Service for any unlawful purpose

6. Intellectual Property

All test results, including recordings and reports, are provided for your use only. You retain ownership of your submitted test specifications. TestHuman retains ownership of its testing methodology and processes.

7. Information You Submit

Information included in your test submissions (URLs, test steps, and related content) should not be considered private or confidential. You are responsible for ensuring that your submissions do not contain:

• Passwords, API keys, or authentication credentials
• Personal data you do not wish to be disclosed
• Trade secrets or proprietary information
• Any other sensitive information you would not want to become public

TestHuman is not liable for any exposure of information you include in your test submissions.

8. Limitation of Liability

TestHuman provides testing services on an "as is" basis. We are not liable for any indirect, incidental, special, or consequential damages arising from your use of our Service. Our total liability is limited to the amount you paid for the specific test in question.

10. Termination

We reserve the right to terminate or suspend access to our Service at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

11. Governing Law

These Terms are governed by the laws of Norway. Any disputes shall be resolved in the courts of Norway.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms.
